Short answer
A Royal Commission Environmental Permit to Operate (EPO) is valid for five years, and the renewal form is due six months before it expires. Missing that deadline carries a fine of 50,000 to 110,000 riyals under Volume III, and all RC comments must be closed before the expiry date. RCER-2025 counts days as working days. The appeal window is stated as 30 days in one clause and 60 days in another.
Key terms used in this guide 9 terms
- Day
- Refers to a working day. RCER-2025 Vol. I, Glossary, page ix
- Environmental Permit to Construct (EPC)
- The Royal Commission permit an operator must obtain before starting any construction activity related to the process of a new facility. An existing facility also needs an EPC, decided case by case, for reconstruction, modification or expansion. RCER-2025 Vol. I, 1.2.1 and 1.2.2, page 5
- Environmental Permit to Operate (EPO)
- The Royal Commission permit without which a facility may not operate or carry out process commissioning. It is valid for five years from the date of issue. RCER-2025 Vol. I, 1.3.1 and 1.3.6, pages 5 and 6
- First Category facility

- Modification
- Any physical change to an existing facility, or change in its method of operation, that increases unit capacity or the pollution emitted to the atmosphere, or causes an impact on the environment that did not occur before. RCER-2025 Vol. I, Glossary, page x
- Modified facility
- A facility subject to a modification with production increases greater than 10 percent, a 10 percent increase in emissions or discharges, or new pollutants emitted or discharged. Clause 1.3.7 of Volume I words the production and emissions tests as 10 percent or more. RCER-2025 Vol. I, Glossary, page x
- Permit Application Package (PAP)
- The package of application forms facilities submit, with the ESQ, to obtain the EPC and EPO. Unless RC says otherwise, everything submitted in it is a condition of the EPO. RCER-2025 Vol. I, 1.1.7 and 1.3.4, pages 2 and 6

How long is a Royal Commission EPO valid?
An EPO is valid for five years from the date of issue.RCER-2025 Vol. I, 1.3.6
Everything submitted in the permit application package becomes a condition of the EPO unless RC says otherwise.RCER-2025 Vol. I, 1.3.4
Amendments to an EPO expire on the same day as the EPO itself.RCER-2025 Vol. II, 1.7.3
When and how do you apply for renewal?
Submit the EPO Renewal Form six months before the EPO expires, plus the permit application package or other documents if RC asks for them. All RC comments must be resolved before the expiry date.RCER-2025 Vol. I, 1.3.6
RC decides on the renewal after reviewing:RCER-2025 Vol. I, 1.3.8
- The renewal form.RCER-2025 Vol. I, 1.3.8
- The permit conditions.RCER-2025 Vol. I, 1.3.8
- The facility's compliance status, exemptions and audit study.RCER-2025 Vol. I, 1.3.8
- An updated permit application package, if needed.RCER-2025 Vol. I, 1.3.8
- The air emission inventory.RCER-2025 Vol. I, 1.3.8
Form PA-R1 asks you to attach the Air Emission Inventory Report, the Cooling Tower Drift Loss Test Report, the Waste Reduction Plan and any other document required by the current EPO.RCER-2025 Vol. II, Form PA-R1, item 12
Legionella monitoring data for cooling towers is also submitted at renewal.RCER-2025 Vol. I, 3.6.6
If RC asks for a full permit application package, you must also give a detailed account of all modifications made during the last permit period. RC inspects the facility as part of the review.RCER-2025 Vol. II, 1.6.1
What is the fine for a late renewal?
Volume I says the appropriate Volume III fine is imposed if the six-month period is not met. Table 3.1 sets the range for that clause at 50,000 to 110,000 riyals.RCER-2025 Vol. III, Table 3.1
RC places each violation in one of six classes, from minor to catastrophic, and considers its nature, gravity, compliance cost, prior offences and good faith. Volume III does not explain how a class maps to a figure within a range.RCER-2025 Vol. III, 3.1.1
Other factors can raise or lower the amount:
- A repeat within two years adds a multiple of the first penalty, using m = 1.1(n-1).RCER-2025 Vol. III, 3.1.2
- A fourth repeat in one class moves the violation to the next class.RCER-2025 Vol. III, 3.6
- Self-reporting with a proactive response multiplies the penalty by 0.75.RCER-2025 Vol. III, 3.2
- Refusing to pay a fine can lead to revocation of the EPO.RCER-2025 Vol. III, 3.5
RCER-2025 does not say what happens if the EPO expires before renewal is granted. Clause 1.3.1 forbids operating without a valid EPO, and Table 3.1 sets 5,000 to 50,000 riyals per month for that clause.RCER-2025 Vol. III, Table 3.1
The renewal fee itself is 15,000 riyals for First Category, 25,000 for Second Category and 50,000 for Third Category facilities.RCER-2025 Vol. III, Table 5.1
How does RC count days?
The glossary of each volume defines a day as a working day.RCER-2025 Vol. III, Glossary
After a Notice of Non-compliance, the operator must:RCER-2025 Vol. III, 4.1.3
- Take immediate measures to minimise the impact.RCER-2025 Vol. III, 4.1.3
- Give reasons and immediate measures within 10 days.RCER-2025 Vol. III, 4.1.3
- Submit a compliance plan and schedule within 20 days.RCER-2025 Vol. III, 4.1.3
- Pay the fine or appeal within 30 days.RCER-2025 Vol. III, 4.1.3
The example Penalty Notice form states these periods as 10, 20 and 30 working days. The Urgent Notice form asks for an explanation within 48 hours and warns of daily penalties.RCER-2025 Vol. III, App. D
How do you appeal an RC fine?
Appeals go to the CEO of the Royal Commission city and are evaluated by the Environmental Penalty Appeal Committee (E-PAC). Once the CEO approves the E-PAC decision, it cannot be re-appealed and the fine is due within 30 days.RCER-2025 Vol. III, 4.2
The texts give two appeal windows. Section 4.1.3 gives 30 days to pay or appeal, while section 4.2 gives 60 days from receipt of the violation notice to appeal to the CEO.RCER-2025 Vol. III, 4.2
Section 4.2 also allows a court appeal under the applicable legal provisions. Not knowing about the violation is not accepted as a reason to reduce or waive a fine.RCER-2025 Vol. III, 4.1.3
Paying the fine does not waive compliance. Within 30 days of payment and receipt of the compliance plan, RC issues a Violation Closure Certificate, which becomes an addendum to the EPO.RCER-2025 Vol. III, 4.3
Do changes made since the last renewal matter?
Yes. Form PA-R1 asks whether production capacity changed, whether new process units or storage areas were added, and whether RC approval was obtained for each.RCER-2025 Vol. II, Form PA-R1
A new or amended EPO is needed when production or emissions rise by 10% or more, or new pollutants are emitted or discharged.RCER-2025 Vol. I, 1.3.7
The glossary words the production test differently. It defines a modified facility as one with production increases greater than 10%, so an increase of exactly 10% is covered by clause 1.3.7 but not by the glossary.RCER-2025 Vol. I, Glossary
Timing also differs between the volumes. Volume II asks for an amended application package six months in advance for a major expansion or significant change.RCER-2025 Vol. II, 1.7.1
Table 9A instead lists 60 days before planned start-up for modified facilities.RCER-2025 Vol. I, Table 9A
Fines for unapproved changes in Table 3.1, in riyals:RCER-2025 Vol. III, Table 3.1
| Cl. 1.3.7: no new or amended EPO for a modification | 10,000 to 40,000 |
|---|---|
| Cl. 1.3.2: operating a modified facility without amendment | 5,000 to 50,000 per month |
| Cl. 1.2.2: modification without an EPC | 200,000 to 500,000 |
| Cl. 1.3.9: each EPO condition not met | 1,000 to 10,000 per condition, plus the clause fine |
| Cl. 1.3.6: late renewal form | 50,000 to 110,000 |

What can go wrong?
These are the usual reasons renewals run late or end in fines:
- Treating expiry as the deadline. The form is due six months earlier, and every RC comment must be closed before expiry.RCER-2025 Vol. I, 1.3.6
- Missing attachments such as the drift loss test, the Waste Reduction Plan or the emission inventory, which delays the review.RCER-2025 Vol. II, Form PA-R1, item 12
- Unapproved changes come to light through PA-R1 items 6 and 7, exposing the facility to modification fines of up to 500,000 riyals.RCER-2025 Vol. III, Table 3.1
- Counting calendar days when RCER defines a day as a working day, or the reverse, and missing a step after a notice.RCER-2025 Vol. I, Glossary
- Relying on the longer 60 day appeal window when section 4.1.3 asks for payment or appeal within 30 days.RCER-2025 Vol. III, 4.1.3
- Losing the 0.75 self-reporting factor by waiting for RC to find a lapse.RCER-2025 Vol. III, 3.2
- A repeat within two years increases the fine, and repeated violations can lead to revocation of the EPO.RCER-2025 Vol. III, 3.6
Renewal checklist
A practical sequence, working back from the expiry date:
- Diary the date six months before expiry and work backwards from it.RCER-2025 Vol. I, 1.3.6
- Complete PA-R1 honestly, with RC approval letters for every change.RCER-2025 Vol. II, Form PA-R1
- Schedule the cooling tower drift loss test early, since its report is due within 60 days of the test.RCER-2025 Vol. I, 3.6.8
- Prepare the Waste Reduction Plan and the air emission inventory.RCER-2025 Vol. I, 5.1.6
- Leave time to close RC comments and the renewal inspection before expiry.RCER-2025 Vol. II, 1.6.2
Hills & Field prepares the PA-R1 renewal package, coordinates the supporting tests and reports, and helps close RC comments before your permit expires.
