Short answer
After an NCEC inspection you must carry out the immediate corrective measures NCEC sets and submit an action plan for the remaining measures within 30 days of the inspection results being issued. NCEC decides on the plan within 15 working days, and you can ask for up to 30 additional days if you submit a preliminary plan with the request. Not developing the plan carries a fine of 20,000 riyals and not implementing it carries 30,000 riyals. Objections to a penalty decision follow the rules and procedures of the committees that review Environmental Law violations, so check those rules for any deadline as soon as you are notified.

What can NCEC inspectors do on your site?
NCEC carries out five types of environmental inspection. They are periodic inspections under the annual plan, emergency inspections, inspections to validate reports and data, inspections after complaints or notifications, and joint inspections with other authorities.Audit reg. (1446H) Art. 4, First (1) to (5)
During an inspection, inspectors may:Audit reg. (1446H) Art. 4, Second (1)
- Enter sites and facilities to carry out the inspection.Audit reg. (1446H) Art. 4, Second (1)(a)
- Review environmental registers and data and keep copies, subject to the confidentiality disclaimer.Audit reg. (1446H) Art. 4, Second (1)(b)
- Take photographs, subject to safety requirements, security precautions and the confidentiality disclaimer.Audit reg. (1446H) Art. 4, Second (1)(c)
- Measure, test and take samples of substances and items on site.Audit reg. (1446H) Art. 4, Second (1)(d) and (e)
- Check that the Environmental Management Plan and any other environmental plans are being implemented.Audit reg. (1446H) Art. 4, Second (1)(f)
- Record violations and take the necessary measures.Audit reg. (1446H) Art. 4, Second (1)(g)
Everyone must cooperate with inspectors and provide registers and related data.Audit reg. (1446H) Art. 4, Second (3)
The model permit conditions in the NCEC permit guide also require you to let NCEC staff enter the project site at any time and provide the information they ask for.Permit guide, Appendix 2, item 3
For critical vital installations with restricted access, NCEC coordinates the inspection with the supervising authority in advance. It shares the purpose, the inspectors' names, the date and time and the data needed.Audit reg. (1446H) Art. 4, Fourth (1) and (2)
A confidentiality disclaimer is a document NCEC gives an activity on request, setting out its confidential information, data, technologies and property rights.Audit reg. (1446H) Art. 1
Keep your permit, its conditions, your environmental registers and recent monitoring reports ready for inspectors. If your site holds sensitive data or technology, ask NCEC for a confidentiality disclaimer before an inspection rather than during it.
What happens right after the inspection?
Inspectors document the outcome of the preliminary inspection and give your representative a copy of the report so that you can correct any violations found.Audit reg. (1446H) Art. 4, Second (2)
If a violation is recorded, the violator signs the violation report. A refusal to sign is noted in the report and the procedure continues anyway.Violations reg. (1446H) Art. 3(4)
The competent authority, which is NCEC for matters in its remit, imposes fines of up to 100,000 riyals. Violation reports with fines above 100,000 riyals go to the Committee.Violations reg. (1446H) Art. 4, First (3) and Art. 3(5)
If a violation needs urgent action to avert an environmental disaster, the Minister or the chairman of the board of the competent authority, or a delegate, may suspend the activity wholly or partly for up to 15 days as a preventive measure. This is done in coordination with the supervising entity.Env Law Art. 44
The violation must then be referred to the competent court or the Committee within 5 days of the suspension. The court or the Committee decides within 10 days of the referral whether the suspension continues.Env Law Art. 44
What must the corrective action plan contain, and when is it due?
You must carry out the immediate corrective measures NCEC sets. For measures that cannot be done immediately for technical reasons, operational procedures or capital expense, you must submit an action plan within 30 days of the date the inspection results are published.Audit reg. (1446H) Art. 4, Third (1)
The action plan must include:Audit reg. (1446H) Art. 4, Third (1)
- Details of the immediate measures already implemented.Audit reg. (1446H) Art. 4, Third (1)(a)
- Technical and timeline details for implementing and monitoring the non-immediate measures.Audit reg. (1446H) Art. 4, Third (1)(b)
- A revised Environmental Management Plan based on the inspection outcome, where your category requires it or NCEC asks for it.Audit reg. (1446H) Art. 4, Third (1)(c)
| Action plan due | 30 days from published results |
|---|---|
| NCEC decision | 15 working days from receipt |
| Extension available | Up to 30 additional days |
| Extension condition | Preliminary plan filed with the request |
NCEC either approves the plan or proposes amendments, and then follows up its implementation.Audit reg. (1446H) Art. 4, Third (2) and (3)
The regulation sets the 30-day plan deadline in days, not working days, while the 15-day NCEC review period is in working days.Audit reg. (1446H) Art. 4, Third (1) and (2)
Table sourceAudit reg. (1446H) Art. 4, Third (1), (2) and (4)
What self-inspection duties continue after the inspection?
Self-inspection is the activity's own internal inspection to confirm compliance with the law, the regulations and environmental requirements. NCEC reviews self-inspection reports and checks how effective your self-inspection programme is.Audit reg. (1446H) Art. 3(4)
NCEC also follows up whether you implement your self-inspection reports, audit studies and corrective action plans.Audit reg. (1446H) Art. 3(7)
The model operating permit conditions in the NCEC permit guide add these duties:Permit guide, Appendix 2
- Submit self-monitoring reports at the interval set in your permit, with measurements and analyses by an NCEC licensed provider.Permit guide, Appendix 2, item 6
- Maintain equipment and pollution control systems and include the maintenance invoices and contracts in the self-monitoring reports.Permit guide, Appendix 2, item 4
- Keep environmental records and show them to inspectors on request.Permit guide, Appendix 2, item 7
- Notify NCEC immediately of emergencies, start-ups or temporary shutdowns that may cause exceedances.Permit guide, Appendix 2, item 10
Missing measurement data from environmental monitoring devices, or not keeping it in the environmental registers, carries a fine of 20,000 riyals. The table marks this violation as one where the warning principle applies, not as serious.Audit reg. (1446H) Art. 8, Table 1, row 12
How do you object to a penalty?
You can object to a fine imposed by the competent authority. The objection follows the rules and procedures for the work of the committees that review Environmental Law violations. The 1446H regulation sets no period of its own.Violations reg. (1446H) Art. 6
The 1446H regulation no longer says what happens if the Committee does not reply, so check the Committee rules.Violations reg. (1446H) Art. 6
Committee decisions can be challenged before the administrative court.Env Law Art. 39(4)
Objections to NCEC decisions on environmental permits follow a different route. They go to NCEC in writing within 15 working days of notification, and NCEC decides within 30 working days.Permits reg. Art. 10(1) and (2)
The Audit regulation does not set out a separate objection procedure for NCEC decisions on a corrective action plan.Audit reg. (1446H) Art. 4, Third
How are inspection fines set, and does reporting a violation yourself help?
Violations of the Audit regulation are recorded and penalised under its Table 1 and the Violations regulation.Audit reg. (1446H) Art. 8(1)
The fine for a serious violation is set by the degree of damage, the natural importance and area of the damaged site, the type of receptors affected and the economic and social effects of the damage.Audit reg. (1446H) Art. 8(2)
Paying the fine does not close the matter. The violator must also correct the violation, repair the damage it caused and pay compensation.Audit reg. (1446H) Art. 8(3)
The competent authority may give the violator an opportunity or a grace period to correct the violation before the penalty is applied, where the violator disclosed the violation voluntarily or reported it itself. This is at the authority's discretion, under controls it sets that the Minister or the chairman of the board approves, as the case may be.Audit reg. (1446H) Art. 8(4)
Compensation collected from violators is deposited in the Environment Fund.Violations reg. (1446H) Art. 5(7)
If your own monitoring or self-inspection finds a breach, a documented voluntary report to NCEC makes a grace period possible under the Audit regulation. NCEC decides whether to grant one.
What can go wrong?
These are the most common ways an inspection turns into a penalty:
- Turning inspectors away without a justification NCEC accepts carries a fine of 20,000 riyals.Audit reg. (1446H) Art. 8, Table 1, item 2
- Preventing inspectors from accessing registers, taking photographs, or taking measurements and samples carries 10,000 riyals for each.Audit reg. (1446H) Art. 8, Table 1, items 4 to 6
- Assaulting inspectors carries 50,000 riyals and referral to the Public Prosecution.Audit reg. (1446H) Art. 8, Table 1, item 3
- Not developing the corrective action plan carries 20,000 riyals. Not implementing it carries 30,000 riyals.Audit reg. (1446H) Art. 8, Table 1, items 7 and 8
- Inaccurate or incorrect information in reports to NCEC carries 1,000 to 50,000 riyals and referral to the Public Prosecution.Audit reg. (1446H) Art. 8, Table 1, item 1
- Permit conditions found unmet during the inspection carry 1,000, 2,000 or 10,000 riyals per requirement for Category 1, 2 or 3 activities.Permits reg. Art. 11, Table 2 (2024), item 6
- Missing any objection deadline set by the Committee rules.Violations reg. (1446H) Art. 6
- For refusing entry, or blocking access to records, photographs, measurements or samples, the penalty table also provides for calling in the concerned body at the Ministry of Interior to act against the violator.Audit reg. (1446H) Art. 8, Table 1, rows 2 and 4 to 6
- Tampering with monitoring devices to disable them or change data and measurements carries 20,000 to 100,000 riyals, set by the volume of functions, data and measurements affected.Audit reg. (1446H) Art. 8, Table 1, row 11
- Using the Environmental Compliance Badge after it has been suspended or cancelled carries 10,000 riyals.Audit reg. (1446H) Art. 8, Table 1, row 13
Checklist after an inspection
A short checklist for the days after an inspection:
- Obtain the preliminary inspection report and log every finding.Audit reg. (1446H) Art. 4, Second (2)
- Close the immediate measures and keep evidence of what was done.Audit reg. (1446H) Art. 4, Third (1)(a)
- Submit the action plan within 30 days, or request an extension of up to 30 days with a preliminary plan.Audit reg. (1446H) Art. 4, Third (1) and (4)
- Revise the Environmental Management Plan if your category requires it or NCEC asks.Audit reg. (1446H) Art. 4, Third (1)(c)
- On the day you are notified of any penalty, check the rules and procedures of the Violations Review Committees and diary any objection deadline they set.Violations reg. (1446H) Art. 6
Hills & Field prepares corrective action plans and revised Environmental Management Plans and follows them through NCEC review.
